Background on FDA Orphan Drug Program. The Orphan Drug Program was created by Congress in 1983 with the enactment of the Orphan Drug Act. See Pub. Law 97-414. Congress had determined that there are "many diseases and conditions . which affect . small numbers of individuals, " and that "because so few individuals are affected by any one rare disease or condition, " companies that develop "orphan drugs" to treat these diseases may "reasonably expect . incur a financial loss" in doing so. Id. 1 b ; . Given the inability of companies to recoup costs incurred in bringing these products to market, Congress found that "orphan drugs will not be developed" absent changes in federal law to incentivize orphan drug development.2 Id. In enacting the Orphan Drug Act, Congress concluded that the high costs and low returns associated with orphan products must not be allowed to impede the availability of such products to rare disease patients. Congress delegated to FDA the authority to determine which drugs and biologicals would be eligible for orphan drug status Federal Food, Drug and Cosmetic Act 526 ; . Rare Disease Therapies and HOPPS. Orphan products and hemophilia blood clotting factors, 3 by their nature, are not well suited to be integrated into the HOPPS payment system, which establishes payment rates based on median imputed costs derived from charge data and departmental cost-to-charge ratios reported by hospitals. These products are natural "outliers" because of their relatively expensive costs and low volumes of usage. Moreover, hospitals vary widely in their utilization of rare disease therapies depending on the concentration of rare disease patients in any given community. This creates two separate problems: First, the infrequency with which many hospitals submit claims in connection with administering these products results in highly variable distributions of charges. This wide variation in reported charge amounts produces a data set that cannot be the basis of meaningful cost imputation for rare disease therapies. Second, the inadequate payments that inevitably result from calculating orphan payment levels under the HOPPS methodology have a particularly adverse impact on hospitals that treat rare disease patients. Congress recognized these difficulties when it established separate "pass-through" payments for these products under HOPPS. See Pub. Law 106-113 201 b ; . Without this separate payment, orphan products and hemophilia blood clotting factors would have been bundled for payment into the Ambulatory Payment Classification "APCs" ; groups of the outpatient procedures with which they were associated. Under such circumstances, costs for orphan products would have been bundled with non-orphan products that often cost considerably less, and with administration procedures the costs for which bear no relationship to the cost of the drugs administered. This would have resulted in a significant loss for hospitals that administer orphan products in the outpatient setting. Recognizing that this loss would be a disincentive for hospitals to stock orphan products.
